BAY BOYS - RULING REVERSED ON APPEAL

2/27/23: The State Appellate Court wrote the plaintiffs had "sufficiently alleged an actionable conspiracy in which the city has participated".

This allows the plaintiffs to pursue a trial (or settlement) if they believe their allegations can be proven in court.

3/14/23: Council decided to seek “appellate review” (by the CA Supreme Court)

MUSIC FESTIVAL APPROVED !

The Council approved a 2500-person music benefit festival for the PVE Foundation in lower Malaga Cove in August. Alcohol will be available.

Motion passed - Council’s approval did not require any funds to be shared with the city. Tickets ($100-250) will be offered to PVE residents first.

Our traditional Old-Fashioned 4th of July Celebration will be restored next year.

Position Rationale

Dear City Council,

As two of the sponsors of the Land Preservation Act that was passed into law by the City Council in 2022 and as long time residents of PVE, we support La Venta as an icon in our community and part of our city’s history.

The city council’s consideration to rezone La Venta (ZTA) without limitations on development rights introduces the risk of La Venta being resold and demolished for high density housing. Because of resident objections to high density, it appears that the city may reconsider, which is our hope. We await further discussion about the Council’s position rescheduled for April.

We appreciate the Council’s efforts to mitigate reasonable concerns between neighbors and La Venta while allowing La Venta to operate a successful venue.
